Özet
Trafik kazasından doğan belgesiz tedavi giderleri, Türk Borçlar Kanunu m. 54’te hükme bağlanan bedensel zarar kalemlerinden biri olan tedavi giderlerinden olmakla birlikte, uygulamada bu giderlerin belgeye bağlanmaması nedeniyle farklı sorunlar ortaya çıkmaktadır. Trafik kazasından doğan bedensel zarar neticesinde zarar görenin yapmak zorunda kaldığı tedavi giderlerinin büyük bir kısmı Sosyal Güvenlik Kurumu(SGK) tarafından karşılanmakla birlikte, çalışmamızın esasını oluşturan belgesiz tedavi giderleri SGK tarafından karşılanmamaktadır. Zarar görenin bedensel zararın giderilmesi veya azaltılması için yapmış olduğu belgesiz tedavi giderlerinin zarar gören üzerinde bırakılması adil olmayacağı gibi tazminat hukukunun temel prensiplerinden olan zarar görenin gerçek zararının tazmin edilmesi ilkesine de aykırı olacaktır. Çalışmada trafik kazası neticesinde zarar görenin yapmak zorunda kaldığı belgesiz tedavi giderlerinin tazminine ilişkin olarak, belgesiz tedavi giderlerinin şartları, kapsamı, belgesiz tedavi giderlerinden sorumluluk, belgesiz tedavi giderlerinin ispatı ve tespiti hususları incelenecektir. Çalışma uygulamadaki örneklerle genişletilecek ve uygulamada tespit edilen sorunlara ilişkin çözüm önerileri sunulacaktır.
Although undocumented treatment expenses arising from traffic accidents are one of the treatment expenses, which is one of the bodily harm items stipulated in Article 54 of the Turkish Code of Obligations, different problems arise since these expenses are not documented in practice. Although most of the treatment expenses that the injured person has to incur as a result of bodily harm arising from a traffic accident are covered by the Social Security Institution (SSI), the undocumented treatment expenses, which constitute the basis of our study, are not covered by the SSI. It would not be fair to leave the undocumented treatment expenses incurred by the injured person to compensate or reduce the bodily harm on the injured person, and it would also be contrary to the principle of compensating the real damage of the injured person, which is one of the basic principles of compensation law. In the study, regarding the compensation of the undocumented treatment expenses incurred by the injured person because of the traffic accident, the conditions and scope of the undocumented treatment expenses, the responsibility for the undocumented treatment expenses, the proof and determination of the undocumented treatment expenses will be examined. The study will be expanded with examples in practice and solutions will be offered for the problems identified in practice.
