Abstract

Genome analysis generally includes all research methods that allow drawing conclusions about the structure and functions of genes. The research, identification and mapping of the genome occur as a result of analysis. In the Personal Data Protection Law, a person’s genetic data is listed among special categories of personal data. Although the relevant law contains restrictive regulations regarding special personal data, there is no special law for the protection of genetic data in our country. However, it is necessary to regulate the limits of intervention regarding genetic data among the person’s health data in a more comprehensive manner. In Germany, there is a regulation in the German Genetic Diagnostic Law regarding the protection of people’s genetic data. The law in question also includes regulations regarding the processing and use of genetic data in the employment relationship. In this context, within the scope of the study, the provisions of the German Genetic Diagnostic Law regarding the employment relationship will be examined and evaluated in order to set an example for our country’s labour law.
