The case subject to the judgment rendered by the Criminal General Assembly of the
Turkisch Court of Cassation on 24 December 2013 unfolded as follows: The defendant
decided to kill (K), who had abducted his wife while the defendant was performing
his military service. The defendant began to investigate (K)’s address, learned the lo-
cation of the shop where (K) was employed, and went there. Mistaking (K)’s younger
brother (C), who was six years his junior and present at the shop at the time, for (K),
the defendant waited for the appropriate moment to carry out his plan to kill. After
leaving the scene and returning later that night, the defendant continued to wait. Once
(C) exited the shop, the defendant fired a shot, killing him. The Court determined that
premeditation, as an qualified element under Article 82(1)(a) of the Turkish Penal
Code (“TCK”), had been established with respect to the offense of intentional killing. It
is equally clear that the offender erred with respect to the identity of the victim. Error
in persona, in terms of the basic form of the offense, does not affect the offender’s
criminal liability. The controversial issue here is whether TCK Article 30/2, which re-
gulates errors in qualified elements, can be applied in the concrete case. The Court of
Cassation distinguishes between qualified elements relating to the victim and relating
to the act itself. Where the qualified elements relates to the act, it is accepted that the
offender’s error in persona cannot be treated as an error in qualified elements. In
such cases, the offender cannot benefit from the error, and the penalty is increased on
account of the qualified element. By contrast, where the qualified element relates to
the victim, the offender may benefit from the error and will be punished for the basic
form of the offense. In cases involving premeditation, since the identity of the victim
is brought to the forefront, it is accepted that the offender should benefit from the
error. The majority of scholarly opinion likewise rests on this distinction. However,
the question of whether premeditation pertains to the victim or to the act remains
contentious. According to another view, since premeditation is associated with the
subjective state of the offender, the aggravating circumstance should still apply even
in cases of error in persona. Similar debates are also conducted with respect to the
qualified elements of intentional killing committed out of blood feud or motivated by
custom. This study will first provide a brief and general explanation concerning error
in persona. Subsequently, it will examine the jurisprudence of the Court of Cassation
and scholarly opinions regarding the effect of error in persona on criminal liability in
cases of intentional killing committed with premeditation. Finally, it will put forward
a theoretical solution intended to contribute to the ongoing debate on this matter.
