With digital developments, taxpayers’ obligations such as reporting, declaration, keeping accounting ledgers, and document preparation have been transferred to an electronic environment. The most important result of this is that copies of the records are sent to the Turkish Revenue Administration database instantly or periodically, stored there, and made accessible by the administration. Furthermore, one of the taxpayers’ obligations is to preserve and present these records. Those who fail to comply with this obligation are subject to imprisonment for the act of “concealment” and other sanctions. There are no separate regulations in the legislation for non-presentation physical and electronic ledgers and documents. Although the administration has electronic records, the obligation to present them still lies with the taxpayer. The purpose of this study is to compare the consequences of failing to present physical and electronic ledgers and documents and to evaluate the concealment of electronic records as an “impossible attempts”. The study cites court decisions and finds that the material element of the act of concealment is not fulfilled, given that access to electronic records is possible. Furthermore, the concealment of electronic ledgers and documents is characterized as an impossible attempt due to the lack of movement, vehicle, and subject. Therefore, it is recommended that the legislation be amended to remove the obligation to present electronic records.
